These terms govern your use of the ScootBooks platform, operated by ScootBooks (Pty) Ltd ("ScootBooks", "we", "our", "us"). By signing up or using the service, you agree to these terms.
1. What ScootBooks is
ScootBooks is a software-as-a-service platform that helps South African scooter rental business owners:
- Manage rent-to-own contracts with their drivers
- Collect weekly payments from drivers via Paystack
- Track scooter service records and reconcile maintenance invoices
- Communicate with drivers via WhatsApp
ScootBooks is not a payment processor — Paystack handles all card transactions. ScootBooks is not a bank or financial services provider.
2. Who can use ScootBooks
You may sign up as an owner if you:
- Are at least 18 years old
- Operate a legitimate scooter rental business in South Africa
- Have a valid bank account in South Africa
- Have a verifiable business registration (or trade as a sole proprietor with a valid SA ID)
Drivers do not sign up directly — they are invited by their owner and interact with ScootBooks only via WhatsApp.
3. Your account
You are responsible for:
- Keeping your login credentials secure
- All activity that happens under your account
- Providing accurate business and personal information
- Notifying us promptly of any unauthorised use
We may suspend or terminate accounts that violate these terms, engage in fraud, or pose a risk to the platform or other users.
4. Fees and payments
ScootBooks charges a flat fee per successful driver payment, currently R25 per transaction. This fee is automatically deducted via Paystack's split payments at the moment of each successful transaction.
We may change our fees with 30 days' written notice. Continued use of the platform after that notice constitutes acceptance of the new fees.
Paystack's own processing fees apply separately and are deducted from the owner's share of each transaction.
5. Your obligations as an owner
When using ScootBooks, you agree to:
- Use the platform only for lawful purposes
- Be honest in your contracts and dealings with drivers
- Treat your drivers fairly and with dignity
- Not misuse the WhatsApp integration to spam, harass, or deceive drivers
- Comply with all applicable South African laws, including consumer protection, lending, and labour laws as they apply to your business
- Pay your service centres and other providers separately — ScootBooks records these transactions but does not pay them on your behalf
- Obtain consent from your drivers before adding them to the platform
6. Our obligations
We will:
- Operate the platform with reasonable care and skill
- Keep your data secure as described in our Privacy Policy
- Process Paystack transactions accurately
- Provide reasonable customer support via WhatsApp and email
- Notify you of significant changes to the service
We do not guarantee that the platform will be available 100% of the time. We may pause the service for maintenance, upgrades, or unexpected issues.
7. What we are not responsible for
ScootBooks is not responsible for:
- Disputes between owners and drivers
- Failure of a driver to pay (we facilitate payments, we don't guarantee them)
- Loss or damage to scooters
- Decisions you make using information from the platform
- Service provider outages (Paystack, WhatsApp, hosting providers)
- Tax obligations arising from your business
To the maximum extent permitted by law, our total liability to you is limited to the fees you have paid us in the 12 months before the event giving rise to the claim.
8. Termination
You may stop using ScootBooks at any time. You can request account closure by contacting us. There is no minimum commitment.
We may terminate or suspend your account if you breach these terms, engage in fraudulent or illegal activity, or pose a risk to other users.
On termination:
- You may export your data within 30 days
- We will retain financial records as required by South African tax law (typically 7 years)
- Other personal data will be deleted in accordance with our Privacy Policy
9. Changes to these terms
We may update these terms from time to time. When we make material changes, we will notify you by email and post a notice on the platform. Continued use of the platform after the changes constitutes acceptance of the new terms.
10. Governing law and dispute resolution
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Gauteng, South Africa.
Before any formal legal action, both parties agree to attempt resolution by good-faith discussion. If that fails, the dispute may be referred to mediation through a mutually agreed mediator.
